Please read these Terms and Conditions (“Terms”) carefully before using the Tergar South Africa NPC website and services (“Service”) operated by Tergar South Africa NPC (“us”, “we”, “our”, or “Tergar South Africa”).

1. Acceptance of Terms

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Service.

2. Relationship with Tergar International

Tergar South Africa NPC is a registered non-profit company in South Africa that collaborates with and supports the mission of Tergar International while operating as an independent legal entity. We are committed to promoting, aiding, and advancing the teachings and practice of meditation and contemplation in alignment with Tergar International’s guidance.

3. Communications

By creating an account on our Service, you agree to receive newsletters, event announcements, and other information we may send. However, you may opt out of receiving any or all of these communications by following the unsubscribe link or instructions provided in any email we send or by contacting us directly.

4. Donations, Purchases, and Event Tickets

4.1 General Payment Terms

If you wish to make a donation, purchase any product or service, or buy tickets to events made available through the Service, you may be asked to supply certain information relevant to your transaction including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that:

  • You have the legal right to use any payment method(s) in connection with any donation or purchase.
  • The information you supply to us is true, correct, and complete.

The Service may employ third-party services for the purpose of facilitating payment and the completion of transactions. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your transaction at any time for reasons including but not limited to product or service availability, errors in description or price, or if fraud or an unauthorized transaction is suspected.

4.2 Event Tickets and Participation

4.2.1 Event Registration and Tickets

When you register for and/or purchase tickets to an event organized by Tergar South Africa NPC:

  • Your ticket purchase is confirmation of your registration and is subject to these Terms.
  • Event tickets may be non-transferable, or transferable only under specific conditions stated at the time of purchase.
  • We may limit the number of tickets available for each person for certain events.
  • Tickets remain the property of Tergar South Africa NPC, and we reserve the right to revoke tickets or deny entry to any person.
  • We may require identification to verify your identity as the ticket purchaser.

4.2.2 Event Cancellation and Refund Policy

  • Tergar South Africa NPC reserves the right to cancel, postpone, or relocate events due to unforeseen circumstances, including but not limited to low enrollment, instructor illness, venue problems, or other circumstances beyond our reasonable control.
  • If Tergar South Africa NPC cancels an event, registrants will be offered the option of a refund less processing fees, as determined by Tergar South Africa NPC.
  • Participant-initiated cancellations:
    • Full refunds (minus any processing fees) may be available if cancellation is received in writing at least 30 days before the event.
    • Partial refunds of may be available if cancellation is received between 30 and 10 days before the event.
    • No refunds will be issued for cancellations received fewer than 10 days before the event.
    • In special circumstances, we may offer credits toward future events or allow you to transfer your registration to another person.

4.2.3 Participant Conduct and Safety

  • Participants must comply with all rules and regulations of the venue, as well as any instructions from event organizers, teachers, and staff.
  • Tergar South Africa NPC reserves the right to remove any participant from an event for inappropriate behavior, without refund.
  • Participants are responsible for their own physical, emotional, and mental well-being during events. You should consult with a healthcare professional before participating in meditation practices if you have any medical or psychological conditions.
  • By registering for an event, you acknowledge that meditation practices may sometimes bring up challenging emotions or experiences.
  • Photography, audio, and video recording may be prohibited during certain events or sessions.

4.2.4 Event Content and Materials

All materials provided at our events are for personal use only and may not be reproduced, distributed, or used for commercial purposes without written permission.

Event content, including teachings, practices, and instructions, is provided for educational and informational purposes only.

Schedules and content of events are subject to change without notice.

5. Tax Deductibility of Donations

Tergar South Africa NPC is registered as a non-profit company in South Africa. Donors are responsible for verifying the tax implications of their donations according to South African tax laws.

6. Content

Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you represent and warrant that:

  • The Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms.
  • The posting of your Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

We reserve the right to terminate the account of anyone found to be infringing on copyright or other intellectual property rights.

You retain all rights to any Content you submit, post, or display on or through the Service. However, by posting Content, you grant us the right and license to use, modify, perform, display, reproduce, and distribute such Content on and through the Service for the purposes of fulfilling our mission.

Tergar South Africa NPC has the right but not the obligation to monitor and edit all Content provided by users.

7. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Tergar South Africa NPC, Tergar International, and their respective licensors. The Service is protected by copyright, trademark, and other laws of South Africa and other countries.

Materials related to the teachings of Yongey Mingyur Rinpoche and meditation practices provided by Tergar International may be subject to separate intellectual property rights and usage restrictions.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Tergar South Africa NPC or Tergar International, as applicable.

8. Accounts

When you create an account with us, you guarantee that you are at least 18 years of age and that the information you provide is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

You are responsible for:

  • Maintaining the confidentiality of your account and password
  • Restricting access to your computer and/or account
  • Accepting responsibility for all activities that occur under your account and/or password

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders or registrations in our sole discretion.

9. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Tergar South Africa NPC.

Tergar South Africa NPC has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Tergar South Africa NPC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Indemnification

You agree to defend, indemnify, and hold harmless Tergar South Africa NPC and its directors, employees, partners, agents, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your Content caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of the Service.

12. Limitation of Liability

In no event shall Tergar South Africa NPC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

This limitation applies whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage, even if a remedy set forth herein is found to have failed of its essential purpose.

13. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Tergar South Africa NPC does not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.
